today at 12: pm some guy hit me in the back of my truck i just need some help what to do
do i need to cal;l the insurance first mine or him insurance?
i have never been in a accident

So What Happened?

i call his insurance and the adjustador (SP) will callme back ,the damage in my truck is worth 4500 dlls ,i call the police and they told me to fill out the pollice report and send it to austin tx,because nobody was hurt.

did you get a police report? if not, it's your word against his, that is not a good situation for you. personally, i would contact my own insurance company and let them fight that battle for me, but again, i hope you have a police report.

i always call the police first because here you have to fill out a police accident form and file it with them and both insurance companies.

Call your insurance company. They will get his insurance info from you and they will contact his insurance company and go from there.

The insurance company will try to handle things quickly and quietly. Don't sign anything dealing with medical/personal injury for at least 2 weeks after the accident, and you've been to a dr.

A friend was in an accident in my car, with my sister. She signed a flat deal for $1500 for injuries because she needed the money. My sister waited. They both ended up going to more dr. appts. My sister, while out of pocket at the start went to the dr. and physical therapy for 6m, was able to add it all up and get reimbursed by the other driver's insurance. My friend had to go through the same thing, but since she had already signed an agreement for medical, she couldn't ask for more money for the dr. bills.

Call your insurance a tell them what happened. Then give them his insurance information. If this happened on a street I think he will be at fault no matter what because he rear ended you. They will contact his insurance and you will be told what to do next. Most likely you will be given a place to take your car to be fixed. His insurance will have to pay as he is at fault. If he does not have insurance or it is expired etc, if you have uninsured motorist on your plan, it will cover it, otherwise you will have to fix it yourself. But first and foremost call your insurance, give the details and his insurance info and go from there. How is your neck? If it were me I would go to the dr and get checked out because he should have to cover any medical bills should you need anything done for any muscle pain. Good luck!!!:)

I've been in several accidents. I agree with Jen B.  Start by calling your insurance to report the damage to your car--they are, after all, insuring your property against damage. (If your insurance doesn't want to be involved, they will tell you to call the other insurance company.) You give your insurance company the other driver's insurance info and license info.  Your insurance will notify his insurance of your claim.  Your insurance will send out an adjustor to estimate the cost of repairing the damage or they will send you to a body shop in the area that they have a business relationship with.

If you have whiplash or injuries, you mention this at the same time, so that your injury claim does not slip through the cracks and is forgotten.  It may take up to 2-3 weeks for you to feel stiffness or injury.

You really don't want to make any statements to the other insurance company.  They might use it against you if the cause of the accident is contested. Let your insurance company and their lawyers interact with the other party involved. 

Lastly, and this is important, many states required that you file a form to report the accident within a short window of time if the damage is over $500 or some such.  So you need to call your department of motor vehicles (i think its DPS in TX) and make sure you understand what you have to do, otherwise they might send you a citation in the mail.

Police should have been the first call for an accident report to be officially filed and submitted to insurances companies. Then call your company and they walk you through the process---it is one of the reasons you pay them --good luck!

If you have his insurance info call them and file a claim. I would request a rental car as well. I know Florida is a no fault state but not sure about TX. No fault meaning if you are hurt and need medical YOUR insurance comes into play but his will pay the damage to you car and provide you with a rental car.

I would call his insurance co to file a claim if it was his fault. If you notify your insurance co, your insur rates will go up even if it wasn't your fault as it is considered a claim.

If no one was injured, then you should walk in the police report within 24 hours of the incident.

You need to call your insurance company and give them all of his insurance info and the police report number, they should handle it from there.

The few times I have been in an accident, I have tried to keep a level head. I live in New Jersey where insurance is very expensive. Since he hit you from the back it is his fault and he or his insurance will be responsible for repairs to your car. Since I used to work for a body shop, I can tell if the damage to my vehicle is going to be over the deductible. Since he is at fault, I wouldn't worry about the deductible.

I hope you filed a police report. You will need it with either your insurance company or his.

I hope you were not physically injured. It takes a long time to get the well and a long time to get the medical reimbursements or at least that was the case with an accident I had a very long time ago.
